  • DEBTS COLLECTIONS

    We provide collection (including the ser ving of letter s of demand, regular follow ups etc.) and/or advice on any debts or litigation issues of any nature . We render ser vices where cour t action is already pending as well as pre-cour t ser vices. We assist in the drafting of contracts as well as debt related issues. We provide a tracing ser vice at a nominal fee to our clients. We do credit bureau listings and/or checks in accordance with legislation. Other ser vices we render in the collection process are regulated by legislation.

    COLLECTION TOOLS
    Listing debtors as slow and/or bad payers at the relevant credit bureau, in accordance with the relevant legislation. We charge a nominal fee, depending on the complexity of the listing, simply to cover expenses incurred by us. Tariffs might differ from time to time. A tariff list will be provided at an appropriate point in time.

    We do professional tracings of absconded debtors. We charge a nominal fee , depending on the complexity of the tracing, simply to cover expenses incurred by us. Tariffs might differ from time to time . A tariff list will be provided at an appropriate point in time .We send out various forms of letters of demand in accordance with legislation.

    STEPS IN COLLECTION PROCESS
    Telecommunicating with Debtor. Serving of letter of demand at the same time, in accordance with legislation.

    Reaching of agreements with reference to payments, subject to client`s instructions and approval. Confirmation of agreement in writing. Signing of acknowledgement of debt optional and at an additional nominal fee

    Regular follow ups on agreements. Facilitating the payment process. Failure to comply with arrangement and/ or letter of demand, legal action to be taken against debtor, subject to instructions from client.

    We attach hereto the various options and/or routes, but not limited to, the various matters might undergo in layman terms:

    OPTION A:
    Account handed over to Tiyeseko Debt Collections for collection and/or potential litigation purposes. Outstanding amount collected. Debtor complied with the payment terms/plan. 10% collection commission of total outstanding amount with 20% interest per annum will be charged.

    OPTION B
    Account handed over to Tiyeseko Debt Collections for collection and/or potential litigation purposes. All attempts to collect outstanding amount unsuccessful. Summons to be issued, to be served on debtor by Sheriff ’s office. Prayers in Summons will include legal costs the client incurred. Matter undefended. Request for default judgement and subsequent judgement. Processed to credit bureau by Clerk of the relevant Cour t. Issuing of warrant of execution for purposes of confiscating debtor’s assets in order to settle outstanding debts.

    OPTION C:
    Account handed over to Tiyeseko Debt Collections for collection and/or potential litigation purposes. All attempts to collect outstanding amount, unsuccessful. Summons to be issued, to be served on debtor by Sheriff ’s office. Prayers in Summons will include legal costs the client incurred. Matter defended. Cost involved will depend on the legal route the matter takes. Matter might proceed to trial. The trial court will make a rulling in respect to legal costs.

    OPTION D: Account handed over to Tiyeseko Debt Collections for collection and/or potential litigation purposes. All attempts to collect outstanding amount, unsuccessful. ‘ Debtor is sent Letter of Demand; debtor admits liability but still defaults on payment arrangement, request for default judgment, debtor is garnished.

    Due to our vast experience in all aspects of the debt collection industr y we have the ability to deal with instructions at exper t level ensuring our clients that they are in the best possible hands. On receipt of an instruction we attempt to make contact with the client within 24 hours of receipt of the instruction. Should contact not be established the matter is referred to one of our tracing agents who then will make the initial contact. Our client will then be sent an electronic repor t with reference to the conversation and agreement, for the client’s record (These repor ts would assist should it be necessary to take Legal Action). A debtor is allowed only two arrangements (unless otherwise agreed to by the client. In the case of a broken arrangement were an asset is involved it is guaranteed that an initial visit to the debtor will be made within a reasonable period from the date of defaulting. A full repor t including a photo of the asset (if possible) will be forwarded to the client after the initial visit, giving the client a good idea of the condition of the asset.

  • TRACING

    We employ qualified Recovery Agents with vast experience in the tracing industr y. Due to our current economic circumstances consumers get more and more unreachable either to avoid being contacted by collectors due to financial difficulties, or due to the hope that the situation might turn out favorable to them and should there be an asset involved they are allowed to keep possession of the asset. It is our intention to provide our client with as much possible information regarding clients as well as the were-about of the asset (should an asset be involved).

    If the following information is supplied (in which case the debtor must be contactable) a trace would be seen as successful:
    • Employer information (addresses & contact information)
    • Information of a person which the client can definitely be made contact through.
    • If the institution (our client) is contacted due to our involvement.
    • If the client makes payment arrangements due to our involvement.

  • ASSET RECOVERY

    Services Offered

    It is of utmost impor tance that the debtor is made fully aware of all circumstances relating his/her or their account and also the severity of the situation.

    By doing the following the debtor will be made fully aware of the circumstances regarding the above:

    • A Copy of the account histor y (Informing the debtor how the account was conducted).
    • A repor t on prior arrangements made that was not met.
    • Contact information in case the client’s financial circumstances change and he/she or they are able to settle the full arrears or make a suitable arrangement beneficial to our client.

    Note that it is our intention to supply the debtor with the above information in writing should our client permit it.

  • ASSET RECOVERY

    Due to our relation with various attorneys we are able to provide our clients with all Legal Documentation required, including the obtaining of cour t orders if required to do so in order to acquire the asset.

    We are also able to assist with matters that require garnishee orders, sequestrations, liquidations etc.
